Floridas Good, Bad & Ugly

THE BAD (Florida Bad Law)
Gear Up for a Rough Ride: Florida’s Tort Reform and Its Impact on Bikers
Brothers and sisters of the asphalt, there’s a storm brewing over the Sunshine State, and it’s not the kind we can ride out with just our leathers and helmets.
On March 24, 2023, Governor Ron DeSantis revved up and signed House Bill 837, known as “Civil Remedies,” into law.
This piece of legislation isn’t just another roadblock—it’s a full-blown detour that’s set to reroute the entire landscape of civil litigation in Florida. And guess what? This new path is paved in gold for the big insurance companies, leaving us bikers in the dust.
The Countdown Begins: A Tighter Window for Justice

Listen up, riders: if you’re caught in a scrape, the clock’s already ticking louder and faster than before. The time frame to bring forth general negligence claims has been cut down from a leisurely four years to a mere two. What does this mean for us? It’s simple.
We’re forced to hit the gas on our claims, possibly before we even get a handle on how bad the damage is or how deep our injuries run. This plays right into the hands of insurance companies, herding us towards rapid, and probably less generous, settlements. It’s a clear track designed for their victory lap, not ours.
